DuPont's Teflon subject of $5 billion lawsuit

On July 20, 2005 multiple class actions were filed by attorneys in several states, against DuPont Co., charging the chemicals giant hid the potential health hazards of its Teflon non-stick cookware coatings.

The lawsuits filed in federal courts against E.I. DuPont de Nemours Co., call for DuPont to pay damages to class members, create a fund for medical monitoring of consumers who purchased products containing Teflon, and put warning labels on cookware with Teflon. The plaintiffs specifically want DuPont to spend $5 billion to replace the cookware, impose a warning label and create two funds to pay for medical monitoring and scientific research.

"The class of potential plaintiffs could well contain almost every American that has purchased a pot or pan coated with DuPont's non-stick coating," said a plaintiff's lawyer who filed the case.

In May, DuPont said it received a subpoena from the U.S. Justice Department's Environmental Crimes Section to turn over documents about perfluorooctanoic acid (PFOA), a chemical used to make Teflon coatings.

The subpoena came a month after DuPont agreed to settle allegations by the U.S Environmental Protection Agency that the company had failed disclose health data about PFOA for two decades.

In an e-mail statement, DuPont said it would vigorously defend itself against the allegations in the lawsuit.

Other Consumer Products Cases of Interest

The parties have reached a $1,089,627 settlement in an administrative action filed against Mantra Films, Inc., and its sole shareholder, officer, and director, Joseph R. Francis (the seller of ‘Girls Gone Wild’ DVDs and videos), on behalf of all persons who bought the company's products between February 1, 2002, and June 1, 2003, and who canceled their enrollment by returning the first monthly shipment for a refund, but did not get a refund of any shipping costs.
 
The parties have reached a tentative $2.3 million settlement of a class action filed against dietary supplements maker PharmaPrint, Inc. (Pink Sheets: PPRT, formerly OTCBB: PPRT) and certain of its officers and directors by stockholders who purchased the company's common stock between July 1 and November 15, 1999.
 
Computer data loss because of a failed hard drive can be worse than disastrous. The parties have reached a tentative $42.5 million nationwide settlement in an action filed against Fujitsu Computer Products of America, Inc., Hewlett-Packard Company, and Gateway, Inc. on behalf of consumers who purchased Fujitsu MPG3 series and MPF3 series hard drives.
 
A class action lawsuit has been filed in the United States District Court, Southern District of New York against Western Gas Resources, Inc. and Hunter Shively. The case involves violations of antitrust law. No additional information about the substance of the allegations is available at this time. On October 29, 2004, the Court ordered this case to be consolidated with Cornerstone Propone v. Reliant Energy et al.
 
A class action has been filed in the Southern District Court of California against Charlotte Russe Holding, Inc. (NASDAQ:CHIC) and certain of its officers and directors by stockholders who purchased the company's common stock between January 22, 2004 and December 6, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The stockholders seek to recover compensatory damages for the loss of value of their stock.
