A $5 million lawsuit has been filed against the Camden restaurant blamed for one of the largest outbreaks of food-borne illness in South Carolina.
Attorney Robert Phillips says lawyers are seeking class-action status for the lawsuit against the Old South restaurant. Phillips says class-action status would avoid clogging the courts with individual cases.
State health officials say undercooked turkey probably caused the salmonella outbreak. One man died and more than 300 people became ill.
The lawsuit says the restaurant was negligent in failing to store and inspect its food, maintain proper procedures and safeguards, and train and supervise its employees. Old South attorney Drew Williams says his clients are deciding how to respond to the lawsuits.

A class-action lawsuit was filed against The Children's Place because the company violated the Song-Beverly Credit Card Act of 1971, which states a retailer cannot request and record personal identification information from customers who use credit cards. Attorneys claim that The Children's Place then sent the collected phone numbers to a third party data provider and cross referenced the phone numbers to acquire their customers home addresses for marketing purposes. This process, also known as database mining “opens consumers up to identification theft,” said one of the lawyers handling the case. A class action lawsuit filed in Madison County Circuit Court will now be arbitrated, as a result of an appellate court decision. The appeals court has voted to Verizon's motion to compel arbitration and stay judicial proceedings. The suit arises out of a dispute over cancellation fees between Verizon and named plaintiff Dawn Zobrist. When Zobrist became a Verizon customer in July 2001, she entered into a two-year service plan. Zobrist cancelled service in March 2002, and Verizon billed her $175 for a cancellation penalty which Zobrist claims she paid "under protest." The suit seeks financial and other damages.
