Class Action Lawsuit Filed in Formula One Fiasco

Larry Bowers, a Colorado resident, has filed a class action lawsuit against the Fédération Internationale de l'Automobile (FIA), Formula One Group, Formula One Administration, Michelin Tires and the Indianapolis Motor Speedway following Sunday’s United States Grand Prix.

Bowers filed the suit claiming the 2005 USGP was fraudulent after 14 of the 20 drivers pitted and withdrew after the formation lap of the race because of a dispute surrounding the use of Michelin tires on the track.

The lawsuit claims Formula One, the FIA, Michelin, the teams equipped by Michelin and the Indianapolis Motor Speedway forged an agreement allowing the Michelin teams to participate in the formation lap and then exit the track prior to the start of the race.

The lawsuit reads “the alleged ‘race’ participated by just three teams did not constitute a true grand prix race under FIA and Formula One rules in that the race was started with an insufficient number of participants."

Bowers, who bought five tickets to this year’s race and has been a USGP ticket holder since its inception in 2000, is looking to receive a refund for the tickets as well as other costs paid toward attending the USGP.

The controversy failed to dissuade some fans from renewing their tickets for next year's race. Others, however, were there to ask for refunds. Speedway officials were not offering refunds, but did take note of those requesting their money back.

At a late-afternoon press conference, Speedway President Joie Chitwood said track officials will make a decision on refunds and next year's race that takes into account the economic impact on the city, the region and the fans.

"We think America is a great market (for F-1) and we like the fact Indianapolis can play host to it," he said. "I think the U.S. Grand Prix has been good not only for us but for the fans. And I think everyone here in the city would say the same thing."

Chitwood gave no timetable for any decisions by the Speedway. Formula One's governing body has called the teams using Michelin tires to a hearing on June 29 to discuss the matter.

The unfortunate practice of insurance credit scoring is legal under federal law, with some limitations. Four similar class actions have been filed against auto insurance provider Progressive Corporation and related companies on behalf of policyholders who allege that the insurers do not advise them that it uses their credit reports in deciding to force them to pay higher premiums than others, in violation of the federal Equal Credit Opportunity and Fair Credit Reporting acts.
 
Does your GM vehicle make excessive engine noise? Several class actions have been filed against General Motors Corporation on behalf of purchasers of 1999 through 2003 model GM vehicles with a 3.1, 3.4, 4.8, 5.3, 5.7 (LS1), 6.0, or 8.1 liter engine that exhibits a loud noise due to piston slap, who allege that GM actively concealed the engine defect while continuing to advertise, market, and warrant that GM engines are free from defects. Some of the models that may have the defect are the Chevrolet Camaro, Corvette, Silverado, Tahoe and Surburban; GM Denali and Yukon; Cadillac Escalade and Pontiac TransAm.
 
If a fee is properly paid by a business owner, it may be wrong for the business to pass that fee on to consumers. The class has been certified in an action filed against 636 Texas auto dealerships on behalf of certain car buyers who purchased cars after September 1, 1995, and were forced to pay "dealers inventory tax" to the dealerships in violation of the Texas Deceptive Trade Practices Act. The action seeks unspecified compensatory and punitive damages.
 
A federal judge in Oklahoma will soon decide whether to grant class action status to lawsuits that claim General Motors (GM) sold pickups and sport utility vehicles with defective engines, the attorney representing car owners. The lawsuit says that GM produced as many as 800,000 pickups and SUVs between 1999 and 2002 with a noisy defect referred to as piston slap, according to an attorney for the plaintiffs.
 
A lawyer in the town of Girard, Ohio has gotten the ball rolling on a possible class action against pesky traffic cameras. The attorney handling the case said he requested owners of cars photographed speeding by the camera be issued warnings rather than fines until his case is litigated.
