Win-Dar Construction Company Employees Sue for Unpaid Overtime Compensation

A class action lawsuit has been filed in the Middle District Court of Florida against Win-Dar Construction Company Inc. for violations of the Fair Labor Standards Act (FLSA) which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Class members seek unpaid overtime compensation, damages, attorney's fees and costs of the litigation.

Specifically, the complaint alleges that the plaintiff performed work as a non-exempt construction laborer for Win-Dar from July 2001 to the present, regularly worked over forty (40) hours and was not paid overtime compensation as required by the FLSA. In addition, the complaint alleges that Win-Dar failed to properly credit all time worked, including but not limited to driving time, preliminary time and post-liminary time.

A class action lawsuit has been filed in the Northern District Court of California against Trendwest Resorts, Inc. The case involves violations of the Fair Labor Standards Act. A class action lawsuit has been filed against discount retail giant Wal-Mart Stores Inc. on behalf of persons of African American descent who applied and were rejected for truck driving positions based out of Wal-Mart distribution centers in Texas, Arkansas, Louisiana, Mississippi, Tennessee, Georgia, Missouri, Alabama and Kentucky. The action also seeks to represent persons of African American descent who would have applied for driving positions, but were deterred from doing so by their perception that Wal-Mart was biased against applicants of African American descent. The action seeks to enjoin Wal-Mart from continuing the alleged discriminatory practices and seeks financial damages for the rejected job applicants.
 
Morgan Stanley settled a gender bias class-action lawsuit for $46 million. The suit was brought against the Wall Street firm by eight former and current employees who charged that Morgan Stanley deprived them of the trainings, pay raises, and opportunities for promotion that were available to male employees.
 
A statewide collective action has been filed in Indiana against auto parts giant, GPC Napa Auto Parts. The action is brought on behalf of all Indiana Napa managers and assistant managers who were not paid overtime by the company for hours worked in excess of 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks back pay, liquidated and statutory damages as well as injunctive and declaratory relief. As a collective action, all potential claimants must "opt-in" to the action to be considered part of the class. The managers have requested notice be sent to potential claimants.
 
Two former South Sound Les Schwab employees have filed a class action lawsuit against the tire company, saying the company denied them promotions, training and other employment opportunities because they are women.
