VT Consumers Sue Micron Technology for Unfair Competition |

A class action lawsuit has been filed in the District Court of Vermont against Micron Technology Inc. for violations of the Vermont Consumer Fraud Act. Class members allege that the defendants engaged in unfair methods of competition in commerce and overcharged for Dynamic Random Access Memory. Members seek injunctive relief, damages, costs of the litigation and attorney's fees.
Specifically, the complaint alleges that Micron sold and distributed DRAM, a memory chip and the Company's primary semiconductor product used in personal computers, printers, digital cameras, wireless telephones, and other electronic devices, throughout the state of Vermont. More specifically, the complaint alleges that the defendants engaged in contracts and conspiracies to fix, raise, maintain, or stabilize the priced of DRAM in Vermont throughout the class period.
The class consists of anyone who purchased DRAM from the defendants from July 1, 1999 through June 18, 2002.

A class action lawsuit has been filed in the Southern District Court of California against Union Oil Company of California (Unocal) for violations of patent law and the California Business and Professional Code. Class members seek compensatory and punitive damages, attorney's fees and costs of the litigation. The parties have reached a tentative settlement apparently valued at $681,000 in an action filed against maker of McAfee software products, Network Associates, Inc., on behalf of all U.S. residents who purchased McAfee VirusScan version 3 or 4. The action alleged that Network Associates promised to provide perpetual updates to its software, and failed to do so. Persons eligible to take part in the settlement have until July 16, 2004, to avail themselves of a free download of McAfee software. If it tastes too good to be low-cal, maybe it isn't. The parties have reached a $1,025,000 settlement in a class action filed against DeConna Ice Cream Company and Highland Roberts Ice Cream Company on behalf of All persons and entities that purchased Big Daddy branded ice cream at any time between May 1, 1995, and June 17, 2001. Claims must be received by December 31, 2003, to be considered valid.
The parties have reached a settlement valued at $9.7 million in a class action filed against Microsoft Corporation on behalf of consumers who, between March 31, 1995, and December 31, 2002, resided in Vermont and indirectly purchased Microsoft operating system, productivity suite, spreadsheet, or word processing software for use in Vermont. The action alleged that Microsoft violated Vermont’s consumer fraud act by illegitimately using its monopoly power. Persons eligible to take part in the settlement may contact attorneys for the class for more information. On November 17, 2004, the Court approved the proposed settlement in a class action that had been filed against the San Diego Association of Realtors, the North San Diego Association of Realtors, the Pacific Southwest Association of Realtors, Incorporated, the East San Diego County Association of Realtors, Incorporated, the Coronado Association of Realtors and Sandicor, Incorporated for charging smaller realtors higher fees to a multiple listing service (MLS) than larger firms from 1990 to the present. In 2004, Intuit Inc., the makers of the popular financial planning software Quicken, began migrating its Quicken Bill Pay customers from a service run by CheckFree to a new online bill management application made by Metavante.
