FFE Transportation Employees Seek Unpaid Overtime Compensation

A class action lawsuit has been filed in the Northern District Court of Texas against FFE Transportation Services Inc. for violations of the Fair Labor Standards Act (FLSA) which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Class members seek to recover unpaid overtime wages, attorney's fees and costs of the litigation.

Specifically, the complaint alleges that the plaintiffs work as dispatchers, billing clerks, customer service representatives or planners. They are non-exempt current and former employees of the defendant who are or have been required to work more than forty (40) hours per week but have not been paid overtime wages as required by the FLSA.

A class action has been filed against Wheelchair Transport Service, Inc., the largest wheelchair transport service in Florida for violations of the Fair Labor Standards Act (FLSA), specifically for improperly classifying its contract drivers as independent contractors rather than employees. The class also alleges that the company did not compensate them according to FLSA requirements and seeks overtime compensation, minimum wages, liquidated damages, attorneys' fees and costs.
 
A combination collective/class action has been filed in New York against retail giant, Target Corporation. The action is brought on behalf of all target employees who, since January 1998, have not been paid proper wages and proper overtime wages. The action is brought under the federal Fair Labor Standards Act as well as New York labor law and seeks back pay, statutory damages, liquidated damages and injunctive and declaratory relief. As a collective action under the Fair Labor Standards Act, all potential claimants must voluntarily join the action by "opting in". The employees have requested that the court issue notice as quickly as possible to all potential claimants.
 
A statewide collective action has been filed in Florida against Jupiter Animal Hospital, Inc. The action is brought on behalf of all current and former employees, who since April 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A nationwide class action has been filed in Ohio against supermarket giant, The Kroger Company. The action is brought on behalf of all current and former employees of Kroger whose health insurance was either reduced or cancelled while on medical leave or who were not reinstated to their previous position once they returned from medical leave. The action is brought under the federal Family Medical Leave Act and seeks statutory and liquidated damages as well as injunctive and declaratory relief.

A class action has been filed against America Online, Inc. and two related companies on behalf of Californians who served as chat room volunteers and who allege that the company failed to pay them minimum wages and overtime in violation of the California Business & Professions Code.
