Stockholders Sue for Breach of Fiduciary Duties with Columbia Family of Funds

A class action lawsuit has been filed in the Northern District Court of Illinois against Douglas A. Hacker and others for violations of the Investment Company Act. Class members seek compensatory damages, disgorgement of the fees paid to the investment advisors and punitive damages.

This is a national class action lawsuit on behalf of investors in open-ended mutual funds with equity securities holdings in the Columbia Family Funds against the defendant directors, investment advisors and affiliates of the funds alleging that the defendants breached fiduciary duties and duties of care owed directly to the plaintiff and members of the class by failing to ensure that the funds participated in securities class action settlements for which the funds were eligible.

The class consists of all persons who owned any of the funds at any time from January 10, 2002 through January 10, 2005.

A class action has been filed against British vaccine manufacturer Chiron Corporation (Nasdaq: CHIR) and certain of its officers and directors by stockholders who purchased the company’s common stock between July 23, 2003 and October 5, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company’s securities. The stockholders seek to recover compensatory damages for the loss of value of their stock.
 
Stockholders who are hurt by corporate misrepresentations have the right to have their day in court. A class action has been filed against communications company Alamosa Holdings Inc. (OTC:ALMO, formerly Nasdaq: APCS; NYSE: APS) and certain of its officers and directors by stockholders who purchased the company's common stock between January 9, 2001, and June 13, 2002. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
According to a press release dated May 22, 2008, a class action complaint has been on behalf of certain current and former shareholders of Huntington Bancshares Incorporated ("Huntington") whose shares of stock in Waterfield Mortgage Company, Incorporated ("Waterfield") were converted into shares of stock in Sky Financial Group, Inc. ("Sky Financial") in connection with Sky Financial's October 2006 acquisition of Waterfield, and then converted into shares of stock in Huntington in connection with Huntington's July 2007 merger with Sky Financial. The complaint names Huntington and certain Individuals as defendants. The complaint alleges that Huntington, as successor in interest to Sky Financial, violated sections 11 and 12(2) of the Securities Act of 1933, and that the individuals are liable because, under section 15 of the Securities Act of 1933, they were Control Persons of Sky Financial. The complaint seeks damages for members of alleged class who sold shares of stock in Huntington during the class period from November 16, 2007 to the present, or who continue to hold shares of stock in Huntington.
 
The parties have reached a $51 million settlement in a class action filed against former WorldCom, Inc., Chief Executive Officer Bernard Ebbers and 18 ex-WorldCom officials on behalf of employees who lost hundreds of millions of dollars when the long-distance telephone company collapsed. The action alleged that the officials violated the federal Employee Retirement Income Security Act by obtaining and retaining WorldCom stock in the company's 401(k) plans even though they knew of WorldCom's financial problems. Persons eligible to take part in the settlement should contact the attorneys for the class for more information.
 
On September 6, 2005, the Court dismissed several class actions that had been filed against electronic design automation software maker Synopsys, Inc. (Nasdaq:SNPS), and certain of its officers and directors by stockholders who purchased the company's common stock between December 3, 2003, and August 18, 2004. The actions claimed that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
