The action is brought under the federal Fair Labor Standards Act and West Virginia labor laws and seeks back pay, statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants must voluntarily "opt-in" to the action in order to be considered a member of the class. The employees have requested that the court issue notice to all potential claimants.
 
Overtime pay is a hot-button issue in the legislative and judicial sectors today. The class has been certified in an action filed against Eastman Kodak Company on behalf of current and former employees of the company alleging that Kodak's overtime payment policies have violated state and federal labor laws since 1996.
 
Verizon Communications will pay almost $49 million to 12,326 past and present women employees as part of a settlement of a government suit claiming the company discriminated against pregnant women. The U.S. Equal Employment Opportunity Commission reached the settlement in 2002 after accusing Verizon's predecessors, Nynex Corp. and Bell Atlantic, of denying expectant mothers full pension benefits.
 
Federal law protects workers from unexpected job losses due to surprise layoffs. A class action has been filed against accounting giant Arthur Anderson, LLP on behalf of former employees who allege that they were laid off during a 90-day period in violation of the federal Worker Adjustment and Retraining Notification (WARN) Act.
