ETS Staffing Sued by Personnel Coordinators for Unpaid OT

A class action lawsuit has been filed in the Western District Court of New York against ETS Staffing for violations of the Fair Labor Standards Act (FLSA) which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Class members seek an injunction to have the company stop its pay practices, unpaid wages, other damages, attorney’s fees and costs of the litigation.

Specifically, the complaint alleges that ETS Staffing did not pay employees who performed personnel coordinator functions overtime for hours worked over 40 per hour according to FLSA guidelines.

The class includes, without limitation, individuals with the job title of Personnel Coordinator, or with any title who performed similar duties of the named plaintiff and/or the class definition within the past six years.

Employees are seeking statutory damages available under federal law as well as back pay and injunctive and declaratory relief.
 
International Business Machines Corporation, (IBM) faces a lawsuit that was filed in federal court for allegedly not paying overtime to tens of thousands of rank-and-file employees.
 
A statewide collective action has been filed in Florida against Spring Park Drug, Inc. The action is brought on behalf of all current and former employees, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A collective action has been filed in South Carolina against the Richland School District Two. The action is brought on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the school district. The action is brought under the federal Fair Labor Standards Act and is seeking back pay as damages.
 
In 2000, California Supreme Court ruled that workers must get paid for compulsory travel time. The court has rendered a $13+ million and verdict in a class-action filed against D'Arrigo Brothers Company on behalf of laborers, who alleged that the company failed to pay them for thousands of hours spent traveling on company vans to and from the crops they picked between 1996 and 2000. The money will not be distributed until all possible appeals have been exhausted.
 
A nationwide class action has been filed in Ohio against supermarket giant, The Kroger Company. The action is brought on behalf of all current and former employees of Kroger whose health insurance was either reduced or cancelled while on medical leave or who were not reinstated to their previous position once they returned from medical leave. The action is brought under the federal Family Medical Leave Act and seeks statutory and liquidated damages as well as injunctive and declaratory relief.
