Consumer Sues Universal Bank for Unfair Business Practices |
 |
A class action lawsuit has been filed in the Western District Court of Washington against Discover Bank for violations of the Racketeer Influenced and Corrupt Organizations Act (RICO), which addresses the infiltration of legitimate businesses by organized crime. Class members seek treble (triple) damages, attorney’s fees and costs.
Specifically, the complaint alleges that Patsy Cormier was indebted to Universal Bank for over $17,000, which Cormier claims is untrue. She claims that worthless bundles of commercial paper in the form of copies of charged off debt are sold at auction or from debt purchasing organizations. End users then allege that they are third party debt collectors attempting to collect for the original maker of the loan using threats and coercion and that this is a violation of RICO.
