Former Employee of Birmingham Board of Education Sues for Not Being Recalled After Reduction in Force |

A class action lawsuit has been filed in the Northern District Court of Alabama against the Birmingham Board of Education for violations of civil rights law. Class members seek injunctions, back pay, allowances, seniority, tenure status and retirement benefits.
Specifically, the complaint alleges that Travis Brooks is an intentional victim of race discrimination and acts of retaliation by the Birmingham Board of Education for their failure to follow its policies and "recall" him to work after a reduction in force instead of recalling a less qualified Caucasian with less seniority.
Brooks represents present and former African American employees of the Board in its Finance Department. He served as a Director of Accounting in the Finance Department until he was let go due to a reduction in force. He is also suing for retaliation as he alleges that he was not recalled for filing a complaint with the Equal Employment Opportunity Commission (EEOC).

The parties have reached a tentative $60 million settlement in an action filed against the government of Guam on behalf of low-income workers who alleged that the local government failed to correctly credit their taxes. A collective action has been filed in South Carolina against the Spartanburg School District Number Seven. The action is brought on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the school district. The action is brought under the federal Fair Labor Standards Act and is seeking back pay as damages. A statewide collective action has been filed in Florida against Republic Services of Florida, LP. The action is brought on behalf of all current and former employees, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. A class action has been filed against Morgan Stanley Company, Incorporated, a global financial services company providing services on institutional securities, investment management, credit services and institutional securities, for allegedly violating the Fair Labor Standards Act (FLSA) by misclassifying employees as exempt and denying them overtime compensation, holding overtime compensation monies, and wrongfully deducting from the commissions of brokers. The current plaintiff is seeking to subdivide the class into four subclasses, expects the number of class members to total between 100 and 300 and seeks compensatory damages and restitution of all wages withheld. Forty-four former information systems (IS) employees today filed a class action age discrimination lawsuit against Best Buy Company, Inc., in Federal District Court. The suit alleges that the consumer electronics retail giant unlawfully terminated the employment of the plaintiffs and other older IS employees based on their ages, in violation of state and federal anti-discrimination laws. The suit seeks monetary damages and other relief on behalf of the older workers.
