Consumer Sues Law Firm for Violations of Fair Debt Collection Practices Act

A class action lawsuit has been filed in the Eastern District Court of Pennsylvania against Steinberg, Fineo, Berger & Fischoff, PC for violations of the Fair Debt Collection Practices Act (FDCPA) which prohibits debt collectors from engaging in abusive, deceptive and unfair collection practices. Class members seek an injunction specifying that the defendant cease communication with her, damages, reasonable attorney’s fees and cost of the litigation.

Specifically, the complaint alleges that the law firm was hired by Capital One Bank to collect a debt relating to consumer credit card purchases owed by the plaintiff. In May 2004, the firm sent the plaintiff a letter and allegedly tried to coerce the plaintiff into paying the debt.

According to the plaintiff, the letter failed to provide her with notice that the firm was a debt collector, give her notice of her rights to dispute the validity of the debt, request validation of the debt or request the name and address of the original debtor (Capital One). She alleges that these practices are in violation of the FDCPA and as a result, she has sustained damages, including out of pocket expenses and emotional and mental anguish.

Debt collection letters must comply with the federal Fair Debt Collections Act or the collector may find himself owing more than those whom he sends mail. The class has been certified in an action filed against Arrow Financial Services, LLC, on behalf of all consumers with a Connecticut address from whom Arrow sought to collect on a defaulted debt between March 20, 2001, and March 20, 2002. A class action lawsuit has been filed on behalf of loan originators at Kansas based Bank of Blue Valley, Inc. The loan originators claim that they were supervised, treated, and controlled in the same manner as employees, and required to work hours far in excess of 40 per week. Notwithstanding this, the originators claim, they were paid as independent contractors on a commission basis and the amounts paid were far less than what would be required for employees, for straight pay and overtime, under federal labor laws. The loan originators seek back pay and other damages.
 
A class action lawsuit has been filed against H&R Block, a national tax preparation company, in the Southern District Court of West Virginia for violations of federal banking laws. Class members seek damages, attorney's fees and costs of the litigation.
 
A statewide class action has been filed in Indiana against collection specialists Weltman, Weinberg & Reis, Co. LPA. The action is brought on behalf of all Indiana consumers who, since May 6, 2003, received form type collection letters from Weltman, Weinberg that contained a caption resembling a civil complaint, when in fact none had been filed. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
Hundreds of thousands of former BankBoston customers have yet to claim $25 payments they are entitled to under a $12.5 million class-action settlement with Bank of America. Court documents indicate only about 58,000 account holders have filed claims so far, or less than 10 percent of the total. The precise size of the class is unknown, but it is estimated to be 584,000 to 1 million account holders.
 
A class action lawsuit was filed New York on behalf of those who purchased Oppenheimer mutual funds from the AIG Advisor Group, with parent company American International Group Inc as the defendant.
