Maxim Health Systems Home Health Aides Sue for Unpaid Overtime Compensation |

A class action lawsuit has been filed in the Southern District Court of Ohio against Maxim Health Systems, LLC, a health care company who employs more than 56,000 clinicians, allied health professionals, physicians and administrative personnel in cities across the US, for violations of the Fair Labor Standards Act (FLSA) which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Class members seek to recover unpaid overtime compensation, liquidated damages, attorney's fees and costs of the litigation.
Specifically, the complaint alleges that Jocelyn Davies, the lead plaintiff, was employed as a home health aide by Maxim Health Systems from approximately April 2000 until July 2003. She, and other class members, were not paid overtime according to the FLSA and the Ohio Minimum Fair Wage Standards Act, although they worked over forty (40) hours per week.
The class consists of all current and former employees of the defendant who are or were employed to provide domestic service in Ohio to its clients at any time since June 1999 except for those whose claim would be barred by the statute of limitations or those whose administrative and/or professional status exempts them from overtime pay protection.
