Employees of Commissioners Office Sue for OT Compensation

A class action lawsuit has been filed in the District Court of Kansas against the Board of County Commissioners of Johnson County, Kansas for violations of the Fair Labor Standards Act (FLSA) which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. Class members seek to recover unpaid overtime compensation, liquidated damages, attorney's fees and costs.

Specifically, the complaint alleges that the plaintiff worked for the defendant from 2001 to the present. She was routinely required to work an average of fifty-six (56) hours per week totaling 2,912 hours worked per year without receiving overtime pay for approximately 832 hours per year.

Other Employment Cases of Interest

Five North Carolina employees of commercial truckmaker Freightliner have filed a federal lawsuit against the United Auto Workers Union.
 
A statewide collective action has been filed in Florida against Flood Zone Correction, Inc. The action is brought on behalf of all current and former employees, who since April 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
On September 30, 2003, the U.S. District Court for the Southern District of Indiana certified a class of current and former employees of IPALCO, Inc. in an action against the company seeking compensation for losses to class members' 401(k) retirement funds.
 
When American citizens have problems overseas, it is normally a matter for diplomats, not the U.S. court system, but there are exceptions. A class action has been filed against the Kingdom of Saudi Arabia and the General Organization of Social Insurance, an agency of that government, on behalf of American workers who allege that they are being denied benefits by the Saudi government that they were promised in payment for in-country construction and development of Saudi Arabia.
 
Henry Ford Hospital agreed to settle two class action lawsuits filed by seven employees who alleged employment discrimination against African-Americans dating from 1998. Henry Ford Hospital agreed to pay about $1.1 million to class representatives and “eligible members of the class.” Members of the class include hospital employees employed between July 10, 1998, and Dec. 31, 2002, and who are not named plaintiffs. They will receive $350 each. An additional $1 million will fund a series of career-development, mentoring and diversity-training programs at the hospital.
 
A class action lawsuit has been filed in United States District Court against Citigroup Global Markets, Inc. The case was originally filed in San Francisco Superior Court but has been moved to the federal court system at the request of the defendants. The case involves violations of federal labor law. A case management conference before the court has been scheduled for March 5, 2005. No additional information about the substance of the allegations is available at this time.
