A statewide collective action has been filed in Florida against the Asplundh Construction Corporation. The action is brought on behalf of all Florida residents who are either currently, or have been, employed by Asplundh as hourly wage earners and who have not been paid overtime by the company for all hours worked beyond 40 per week. The employees are seeking back pay, statutory damages as well as liquidated damages, injunctive and declaratory relief. As a collective action, all potential claimants are required to voluntarily "opt-in" in order to be considered a member of the class. The employees have requested that the court issue notice to all potential claimants.

More than 250 managers who worked for Abercrombie & Fitch stores across California between July 10, 1998, and April 30, 2004, will share in a $2 million settlement approved by Los Angeles Superior Court Judge Kenneth R. Freeman. The case was filed in July 2002, and the class was certified on September 14, 2004.

A class action lawsuit has been filed in the District Court of South Carolina against the South Carolina Department of Transportation. The class has been certified in an action filed against Eastman Kodak Company on behalf of current and former employees of the company alleging that Kodak's overtime payment policies have violated state and federal labor laws since 1996.

A class action lawsuit has been filed in the District Court of Columbia (Washington DC) against William Henderson Postmaster General for violations of civil rights law. Class members seek, among other things, compensatory damages, damages for emotional distress, mental anguish and humiliation, interest, any promotion and/or increase he would have acquired but for the discrimination, front and back pay, attorney's fees and costs of the litigation.

Grocery chain Smart & Final reached a tentative $19 million agreement in a class-action lawsuit claiming employees were not properly paid. The employees alleged the Los Angeles-based chain failed to properly calculate overtime pay and also neglected to pay for all hours worked. The suit also alleged other compensation was not paid.
