A class action lawsuit has been filed in the Southern District Court of Ohio against the Ohio Education Association (OEA) for violations of the Labor Management Relations Act for breaching a collective bargaining agreement. Class members seek to enjoin OEA from breaching the collective bargaining agreement, to obtain an order restoring benefits coverage, to be made whole for losses, attorney's fees and costs. Royal Dutch/Shell Group agreed to pay about $90 million to settle a lawsuit brought by its U.S. employees after the company overstated its oil and gas reserves by 41 percent.
The accord brings to about $240 million costs related to the overstatement, which led to lawsuits, criminal investigations and the ouster of Chief Executive Philip Watts. Insurance will cover $25 million of the settlement, Shell said in a statement July 12, 2005. A class action lawsuit has been filed on behalf of employees of the Texas based chiropractic office franchise Accident & Injury Pain Centers, Inc. The suit alleges that the company routinely denied overtime pay to employees who had worked hours in excess of 40 per week. The workers are seeking back overtime pay and other damages. Wal-Mart became the target of another class-action lawsuit, filed by advocates for workers in six countries who charged the company overlooks labor abuse at factories run by its suppliers.
The lawsuit, filed in California Superior Court in Los Angeles, lists as plaintiffs 15 workers in Bangladesh, Swaziland, Indonesia, China and Nicaragua. The lawsuit claims they were paid below minimum wage in their country, forced to work unpaid overtime and in some cases even endured beatings by supervisors. It asserts that Wal-Mart failed to enforce worker treatment provisions of its contracts with suppliers. Federal civil rights law has as its goal equalization of the employment playing field so that all people have a fair chance at advancement. The parties have reached a tentative $1.9+ million settlement in an action filed against Kash n' Karry Food Stores, Inc. on behalf of all current and former female management and non-management associates of the company who worked at any time between June 10, 1999, and August 22, 2003, in Kash n' Karry's retail operations and completed their 90-day probationary period on or before August 22, 2003. Claims must be postmarked no later than November 21, 2003, to be considered valid.
