Former Troubled New York City Youths Sue for Their Right to Attend School

A class action lawsuit has been filed in the Eastern District Court of New York against Richard Mills, Commissioner of the New York State Educational Department for violations of the New York State Education Law, the New York City Chancellor's Regulations and the Individuals with Disabilities Education Act, among others. Class members seek declaratory and injunctive relief.

Specifically, the complaint alleges that youths and disabled children from the ages of seven (7) to twenty-one (21), who have a history of involvement with the juvenile or adult court systems, have been denied a proper and free education in New York City public schools after being discharged from court-ordered settings.

Note: The plaintiffs' names are not revealed in the complaint because they are juveniles.

The action is brought on behalf of all individuals employed as "Loan Processors" or "Loan Coordinators" since November 14, 1999, who were allegedly not paid proper overtime compensation, were not paid for all hours worked, were not provided with state mandated break periods and who were not promptly and correctly compensated upon termination or resignation. The employees are seeking back pay, compensatory damages, disgorgement of profits, statutory damages and declaratory and injunctive relief. The action is brought under both the federal Fair Labor Standards Act as well as California wage law and is a collective action. As a collective action, all potential class members are required to join the action in order to recover.
 
A combination class action/collective action has been filed in Ohio against the telemarketing service, Smart Choice Marketing, Inc. The action is brought on behalf of all Ohio residents who are currently, or were employed by Smart Choice from December 1, 2000, to the present as hourly telemarketers and whose working time was tracked and recorded by the use of the computer dialer and who were not paid overtime compensation as a result. The action alleges that Smart Choice engaged in an intentional and systematic course of conduct which was aimed at denying its hourly employees proper overtime compensation. The action is brought as a class action under Ohio Minimum Fair Wage Standards Law and as a collective action under the federal Fair Labor Standards Law. The employees are seeking back pay, liquidated and statutory damages as well as injunctive and declaratory relief. As a collective action, potential claimants are required to "opt-in" to the case. The employees have requested that the court issue notice to all potential claimants.
 
A statewide collective action has been filed in Florida against National Financial Systems, Inc. The action is brought on behalf of all current and former hourly employees of all Florida National Financial locations, who since May 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A nationwide class action has been filed in New York against Pressler & Pressler, P.A. The action is brought on behalf of all consumers who, since December 1, 2002, received a "form" type collection letter from Pressler & Pressler attempting to collect a debt for Capital One Bank that included a legal style caption on the letter. According to consumers, Pressler & Pressler has violated the federal Fair Debt Collection Practices Act by making false and misleading assertions in an attempt to collect a debt. Consumers are seeking unspecified compensatory and statutory damages, disgorgement of profits and declaratory and injunctive relief.

The action is brought on behalf of all current and former employees, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
