A partial judgment has been entered against Honeywell International, Inc. on behalf of retirees from three auto parts plants formerly owned by Bendix Corporation, who allege that Honeywell--Bendix's successor--failed to honor their guaranteed levels of health and life insurance under a 1976 agreement between Bendix and the United Auto Workers. A statewide class action has been filed in Florida against Morningstar Holdings, LLC, the owner and operator of The Bonati Institute. The action is brought on behalf of all former employees of Bonati who were terminated when Bonati suddenly closed its doors on December 19, 2003. The action is brought under the Federal Worker Adjustment and Retraining Notification Act (WARN) and seeks damages in the form of 60 days pay, bonuses, accrued vacation time and holiday pay as well as pension and 401k contributions and health and medical insurance contributions and any medical expenses incurred during the period where coverage should have been provided. A class action has been filed against Elli's Associates for violations of the Fair Labor Standards Act (FLSA) and the New York Minimum Wage Act, specifically for the failure to pay overtime to its employees. The class seeks their unpaid regular wages, unpaid overtime compensation, an additional 25 percent as liquidated damages, reasonable attorneys' fees and costs of the action. A class action lawsuit has been filed in the Chancery Division of Cook County (Chicago) Superior Court against Illinois based retailer Sears Roebuck & Co. The case was brought by the Central Laborers Pension Fund and may involve the company’s benefit plans. No additional information about the substance of the allegations is available at this time. A nationwide class action has been filed against the US Department of Agriculture on behalf of black farmers who farmed or attempted to farm between January 1, 1997, and August 30, 2004, and who allege that the agency has conspired to take their land through tacit racial discrimination expressed through government farm loan and program policies. The lawsuit alleges that the USDA has violated the 14th amendment of the American Constitution, the federal Civil Rights Act of 1964, and the Equal Credit Opportunity Act, and seeks at least $20.5 billion in damages. A class action has been filed on behalf of home health care workers employed by the Central State Community Services, Inc., a Tulsa based provider of home health services. The suit alleges that workers employed at Central State between 2001 and 2004 routinely worked more than 40 hours a week but were not paid overtime as required by the Federal Fair Labor Standards Act. The plaintiffs seek an award of the unpaid overtime with interest, attorney’s fees and costs, as well as liquidated damages and equitable relief.
