A class-action lawsuit filed in federal court in Miami, Florida, alleges that cell phone insurance is being promoted in a “deceptive and outrageous” manner by cell phone equipment insurers. Madison County, Illinois Circuit Judge Daniel Stack reduced a once-heavy national class action suit against American Family Mutual Insurance even further from 17 states down to a trim 12.
The lawsuit was filed by Manual Hernandez, who claimed in 2000 that American Family improperly used computer software to reduce payments on medical claims from auto accidents. The lawsuit was certified as a class action in 2002 by Judge Stack.
In 1998, Hurricane Georges struck Mississippi, causing more than $400 million in damage. A class action has been filed against State Farm Fire and Casualty Company and Allstate Insurance Company on behalf of Mississippi Gulf Coast residents who allege that the insurers caused unreasonable financial hardship in violation of state insurance law when they unfairly penalized homeowners by imposing a 2% deductible on homeowners' insurance policies in the aftermath of hurricane Georges. Loan contracts can be extraordinarily complex--you need to read them very carefully before signing on the dotted line. A class action has been filed against World Savings and Loan Association on behalf of California borrowers under secured loans made or serviced by World alleging that the company used unnecessarily expensive hazard insurance policies to illicitly make additional profits, breaching their contracts and violating the California Business and Professions Code. The class has been certified in a nationwide action filed against Liberty Life Insurance Company on behalf of all African-Americans who are current or former owners of industrial life insurance policies issued by Liberty Life or any insurance companies acquired by Liberty Life, and who were charged race-based premiums that were greater than premiums charged to similarly situated Caucasians. The action alleges that the company committed fraud and violated state unfair practices laws when it used blatantly discriminatory sales tactics to target unsophisticated consumers as potential buyers of industrial insurance, also known as burial insurance.
