Riddle & Associates Engaged in Abusive and Deceptive Collection Practices, According to Plaintiff

A class action lawsuit has been filed against New York collection agent Riddle & Associates, PC. The suit alleges that the defendant engaged in abusive and deceptive collection practices that violated federal fair debt collection practices laws. The suit seeks to certify a national class and collect actual and punitive damages on behalf of the plaintiffs.

Specifically, the suit alleges that the defendant violated federal fair debt collection practices law in collecting a debt for Direct TV. The collection agent, in telephone calls to the plaintiff, allegedly misrepresented the imminence of a lawsuit and the likely costs. The defendant also allegedly violated the law in stating that the plaintiff had no right to contact Direct TV or attempt to resolve the debt without working through the credit bureau.

A national class action has been filed in Texas against insurance giant United Guaranty Residential Insurance Company on behalf of all consumers for whom United Guaranty issued a mortgage insurance policy at a disadvantageous rate due to derogatory information contained in a credit report, and who did not receive notice that derogatory information obtained from a credit report was used in setting the insurance premium. The insureds claim that United Guaranty uses credit reports to set premiums but does not provide any information to consumers when an adverse decision has been made against them based on that report. The insureds allege that this violates the federal fair credit reporting act and are seeking actual damages as well as statutory damages and declaratory relief.
 
A statewide class action has been filed in New York against collection specialists, Cohen & Slamowitz. The action is brought on behalf of all New York residents who received form type collection letters from the firm and/or who have been alleged victims of the firm’s alleged harassing collection tactics. The action is brought under the federal Fair Debt Collection Practices Act and seeks actual and statutory damages as well as injunctive and declaratory relief.
 
A class action has been filed against U.S. Bank and its Indiana collections attorney, Septtimous Taylor, by Indiana residents whose mortgage is held by U.S. Bank and who, at any time since October 10, 2001, were charged foreclosure fees and court costs although foreclosure actions had not been filed in court. Additionally, the action claims that Taylor violated the federal Fair Debt Collection Practices Act. The action seeks restitution and compensatory and statutory damages.
 
A class action lawsuit has been filed on behalf of Kansas residents who were the subject of garnishment proceedings initiated by Midwest Checkrite, Inc. The suit alleges that Midwest Checkrite failed to adhere to the requirements of the federal fair debt collection practices act with respect to its garnishment efforts.
 
A class action lawsuit has been filed on behalf of debtors of Superior Asset Management, Inc. The suit alleges that Affiliated failed to adhere to the requirements of the federal fair debt collection practices act in its interactions with debtors.
