Feed Producer Required Overtime But Refused to Pay for It, Lawsuit Claims

Hourly workers employed by Texas based Pilgrim's Pride Corporation have filed a class action lawsuit claiming that the feed producer routinely requires or permits its workers to work hours in excess of 40 per week without receiving overtime. The complaint alleges that this denial of overtime violates the federal Fair Labor Standards Act. The plaintiffs seek an award of the unpaid overtime together with interest, costs and other damages.

Under the federal Fair Labor Standards Act employers are required to pay all non exempt employees time and one half for all hours worked in excess of 40 per week.

The case was originally filed in California state court and has now been removed to the federal court system. The case involves violations of federal labor law. The case involves violations of federal labor law, specifically the Employee Retirement Income Security Act, which governs employer handling of pension and benefit plans.
