The American Civil Liberties Union is on record as one of the attorneys in the case, which appears to involve allegations that cetain California Laws are unconstitutional and may violate the rights of certain citizens. Other Civil Rights Cases of Interest

Ashley Peach of Illinois filed a class action suit against Wal-Mart on June 16, 2004, alleging the cashier at Wal-Mart failed to return a $1.39 balance on her gift card. In the complaint, sometime after Mother’s Day in May 2004, Peach purchased shampoo, conditioner, and other toiletries from the Granite City Wal-Mart, using two separate $10 gift cards to pay for the purchase that totaled $18.61.
 
A national collective action was filed in Florida on 2/2/2004 against lending giant, Oak Street Mortgage, LLC. The action was brought on behalf of all current and former loan officers, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action was brought under the federal Fair Labor Standards Act and seeks back pay, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. On 5/18/2004, the Magistrate Judge recommended conditionally certifying a class of all loan officers employed by Oak Street at one of its branch offices located in Greenville, South Carolina, Atlanta, Georgia, St. Petersburg, Florida or Ocala, Florida.
 
Forty-four former information systems (IS) employees today filed a class action age discrimination lawsuit against Best Buy Company, Inc., in Federal District Court. The suit alleges that the consumer electronics retail giant unlawfully terminated the employment of the plaintiffs and other older IS employees based on their ages, in violation of state and federal anti-discrimination laws. The suit seeks monetary damages and other relief on behalf of the older workers.
 
A statewide collective action has been filed in Florida against Custom Pak, Inc. The action is brought on behalf of all current and former employees, who since March 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A class action lawsuit has been filed by the Ohio Democratic party and individual voters in the US District Court. The case is brought on behalf of registered Ohio voters and claims that, on the eve of the hotly contested 2004 presidential election, the Ohio Republican Party and the Republican National Committee are attempting to selectively disqualify registered and eligible Ohio voters in an effort to influence election results. The suit seeks injunctive relief and damages on behalf of voters wrongfully disqualified from participating in the election.
 
A statewide class action has been filed in California against collection specialist, Encore Receivable Management, Inc. The action is brought on behalf of all California residents who received a collection letter from Encore which offered to settle their alleged debt for a lesser amount, if payment was made immediately. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
