Former Racetrac Petroleum Employee Sues for Job Misclassification in Violation of FLSA

A class action lawsuit has been filed in the Northern District Court of Georgia against Racetrac Petroleum, Inc. for violations of the Fair Labor Standards Act (FLSA). Class members seek back pay, front pay, liquidated damages, interest, and attorney's fees and costs of the litigation.

Specifically, the complaint alleges that Caron was hired to work at the company's headquarters in Georgia as a Network Operation Center Operator, an exempt position. She claims that the position should have been classified as non-exempt because she exercised little independent judgment and that she should be compensated for the hours she regularly worked over forty hours.

In addition, she alleges that she was terminated after complaining about the company's overtime policies and is also suing for retaliation. She also alleges that the company discriminated against her because of her sex because her pay was less than that of a male in the same position.

A statewide collective action has been filed in Florida against All Restoration Services, Inc. The action is brought on behalf of all current and former employees, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A collective action has been filed in Florida against the School Board of Broward County on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the board. The action is brought under the federal Fair Labor Standards Act and is seeking back pay, statutory damages, liquidated damages and declaratory relief.
 
Nurses and other hospital employees in the Ohio cities of Cincinnati, Lima, Lorain, Springfield, and Toledo filed a lawsuit against Catholic Healthcare Partners, claiming Ohio's largest hospital system violates federal and state wage-and-hour laws.

The action is brought on behalf of all current and former employees who, since December 22, 1997, worked in either inside insurance sales or payroll service sales and were not paid overtime compensation. The action is brought under both New York labor law and the federal Fair Labor Standards Act and seeks back pay, statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants are required to voluntarily "opt-in" to be a considered a member of the class. The employees have requested that the court issue notice to all potential claimants.
