A class action lawsuit has been filed on behalf of employees of Florida based Subway Plaza Corporation. The suit alleges that the company routinely denied overtime pay to employees who had worked hours in excess of 40 per week. The workers are seeking back overtime pay and other damages.
 
A nationwide class/collective action has been filed in California against truck stop Giant, Pilot Travel Centers, LLC and its parent company, Pilot Corporation. The action is brought on behalf of all general managers, co-managers, operations managers, sales managers, guest service managers, and human resource managers who since December 11, 1999, in California and December 11, 2000, nationwide were denied overtime compensation by Pilot. The action is brought both under the federal Fair Labor Standards Act and the California labor and business professions codes and seeks back pay, liquidated damages and statutory penalties as well as declaratory and injunctive relief. The action is both a class action, for violations of California law, and a collective action under the federal Fair Labor Standards Act. Those residing outside of California who wish to be considered for the action must "opt-in" voluntarily to be considered a claimant. The managers have requested the court give notice to all potential claimants.
 
A settlement between the U.S. Postal Service and disabled postal workers allegedly placed in "dead end" jobs after becoming disabled on the job has been granted preliminary approval by a Denver Equal Employment Opportunity Commission court. The action was brought on behalf of all U.S. postal workers who between the dates of January 1, 1993 and December 3, 2003 were allegedly denied promotion and advancement opportunities after becoming disabled on the job and placed into "permanent rehabilitation" positions by the Post Office. Under the terms of the settlement, each worker who proves a claim may be eligible for up to $25,000 in damages from the U.S. Government. Notice to all potential class members is scheduled to be mailed early in January, 2004, with final approval of the settlement anticipated in Spring, 2004.
 
A class action has been filed against Waffle House, Inc., a restaurant headquartered in Georgia, for violating the Fair Labor Standards Act (FLSA) by paying its wait staff for less time they actually worked and for not paying for overtime. The class members seek unpaid back wages, other compensation due, and attorney’s fees and costs.
 
A class action lawsuit has been filed in the Northern District Court of Illinois against Abbott Laboratories and Hospira, Inc. for violations of the employee retirement income security act (ERISA).
