A federal class action has been filed against the Kentucky based Trover Clinic Foundation and its associated network of hospitals and medical officers. The suit alleges that over 415 individuals who sued Trover Clinic in state court were subsequently contacted and told that they would not be treated at any Trover affiliated facility unless they accepted the terms of a settlement offer put forward by Trover. Many of the plaintiffs are cancer patients who would have been forced to seek treatment out of state as a result of Trover's refusal to treat them.
The suit is being brought to federal court now because many of the plaintiffs affected by the refusals of care are medicare and Medicaid recipients whom Trover is prohibited from denying essential treatment under federal law. Over 200 users of the sets have been hospitalized for treatment of conditions related to the malfunction of the insulin delivery devices. A class action has been filed against biopharmaceutical company Titan Pharmaceuticals, Inc. (AMEX: TTP) and certain of its officers and directors by stockholders who purchased the company's common stock between December 1, 1999, and July 22, 2002. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
