A national class action has been filed against prescription drug plan operator Express Scripts, Inc. on behalf of all U.S. citizens who were or are participants in or beneficiaries of any employer-provided prescription benefit plan (1) that required participants or beneficiaries to pay a percentage co-pay for prescription drugs and (2) for which Express Scripts, Inc. or one of its predecessors-in-interest or subsidiaries serves or has served as the plan's provider of prescription drugs at any time from October 1, 1997, through the present. The action is brought under the Employee Retirement Income Security Act (ERISA) and claims that Express Scripts breached its fiduciary duty to plan participants and beneficiaries in several ways. The participants are seeking declaratory and injunctive relief and a court order requiring Express Scripts to make an accounting of and reimburse consumers and benefit plans all monies earned through allegedly unlawful activities.
An FTC administrative proceeding has been filed against the Internet Marketing Group, Inc., and affiliated businesses OneSetPrice, Inc., RPM Marketing Group, Inc., National Events Coordinators, Inc.; First Choice Terminal, Inc.; First Choice Terminal, Inc.; and B & C Ventures, Inc., on behalf of consumers who bought into multipurpose public access Internet terminal and telephone calling card business ventures since August 2001. The action accuses the defendants of making false and unsubstantiated earnings claims, and misrepresenting their cancellation and refund policies, in violation of the FTC's Franchise Rule and Telemarketing Sales Rule. More than 250 managers who worked for Abercrombie & Fitch stores across California between July 10, 1998, and April 30, 2004, will share in a $2 million settlement approved by Los Angeles Superior Court Judge Kenneth R. Freeman. The case was filed in July 2002, and the class was certified on September 14, 2004.

The action is brought on behalf of all current and former employees, who since March 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week.
