Collection Agency Sued for Sending Forged Letters to Consumers from Attorney

A class action lawsuit has been filed in the Northern District Court of Alabama against Franklin Collection Services, Inc. for violations of the Fair Debt Collection Practices Act (FDCPA). Class members seek actual and statutory damages, attorney's fees and costs of the litigation.

Specifically, the complaint alleges that Franklin Collection Services, Inc., a Mississippi based collection agency, conspired to violate the FDCPA by mailing letters to consumers, purportedly from Jeffrey Waldo, a Mississippi attorney. The letters threatened legal action against debtors unless they contacted him to make arrangements to pay the debts when in fact the letters were written by the collection agency instead. More specifically, the complaint alleges that Attorney Waldo knew that his name was being used to threaten consumers, but allowed the practice to continue.

A statewide class action has been filed in Indiana against collection specialists Weltman, Weinberg & Reis, Co. LPA. The action is brought on behalf of all Indiana consumers who, since May 6, 2003, received form type collection letters from Weltman, Weinberg that contained a caption resembling a civil complaint, when in fact none had been filed. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
A class action lawsuit has been filed in federal court against Novastar Financial. The case involves allegations of fraud. Although originally filed in Madision County, Illinois state court, the case has been removed to the federal court system at the request of the defendants. The defendants have also filed a motion to dismiss the case. No additional information about the substance of the allegations is available at this time. A class action lawsuit has been filed in the Eastern District Court of New York against Credit Collection Services, Inc., a New York based collection agency, for violations of the Fair Debt Collection Practices Act (FDCPA) which prohibits debt collectors from engaging in abusive, deceptive and unfair collection practices. Class members seek damages, attorney's fees and costs of the litigation.
 
A class action lawsuit has been filed on behalf of Indiana residents who received collection letters from Affiliated Group d/b/a Affiliated Credit Services. The suit alleges that Affiliated failed to adhere to the requirements of the federal fair debt collection practices act in its interactions with debtors.
 
A class action has been filed against lender MicroFinancial, Inc. (NYSE: MFI) and certain of its officers and directors by stockholders who purchased the company's common stock between February 5, 1999, and October 30, 2002. The stockholders seek to recover compensatory damages for the loss of value of their stock.
