A class action lawsuit has been filed in the Eastern District Court of Texas against Cai, Inc. for violations of the Fair Labor Standards Act (FLSA). Class members seek to recover unpaid regular wages, overtime compensation, attorney's fees and costs of the litigation.
Specifically, the complaint alleges that Chana Burks worked for Cai, Inc. to perform services at facilities owned and operated by Hood Flexible Packaging Corporation, Inc. Cai employs technicians to mix and prepare ink that is used in the manufacturing process for various products.
Burks was a non-exempt employee, regularly worked over forty hours per week, but was not paid overtime as required by the Fair Labor Standards Act. She complained to her employer about this practice, but nothing was done. In August of 2004, she requested information from her employer about maternity leave policies and was terminated a few days later.
