Anchor Glass Stockholders Sue for $41M

A class action has been filed in the Middle District Court of Florida against Anchor Glass Container Corporation (NASDAQ: AGCC) and certain of its officers and directors by stockholders who purchased the company's common stock between September 25, 2003 and November 4, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The stockholders seek to recover compensatory damages for the loss of value of their stock.

Specifically, the complaint alleges that Anchor went public with an initial public offering on September 23, 2003. Throughout the class period, the defendants allegedly touted their increasing sales and profitability causing their stock price to rise over $17 per share. Insiders cashed out both in the initial public offering and afterwards when they sold over $4.4 million worth of stock at artificially inflated prices. On November 5, 2004, defendants announced a much greater than expected net loss, a major company revamping including the closure of a major container facility, the suspension of the quarterly dividend and the sudden resignation of their CEO, Richard Deneau. As a result of this announcement, the company's stock dropped over 25%.

The stockholders seek to recover compensatory damages for the loss of value of their stock.
 
According to a press release dated June 5, 2008, the complaint charges Healthways and certain of its officers and directors with violations of the Securities Exchange Act of 1934. Healthways provides disease management and wellness programs for health plans, hospitals and small businesses, helping members with diabetes, cancer and other diseases to coordinate care, keep up with treatment and maintain healthy behaviors.
 
On May 12, 2008, a motion to consolidate cases, to appoint lead plaintiffs and for the approval of the selection of lead counsels was filed by City of Fort Myers Police Officers' Retirement System.
 
The United States District Court for the Middle District of Florida has entered an order preliminarily approving the settlement of the securities class action entitled In re Sunterra Corporation Securities Litigation.
 
Kahn Gauthier Swick, LLC ("KGS") announces that shareholders of Jones Soda Company ("Jones Soda" or the “Company”) (Nasdaq:JSDA) who purchased shares of the Company between March 9, 2007 and August 2, 2007 (the "Class Period"), have until November 5, 2007 to move for appointment as Lead Plaintiff in a securities class action lawsuit currently pending in the United States District Court for the Western District of Washington. No class has yet been certified in this action.
