Educational Rep Sues American Music Group Sues for Unpaid OT

A class action lawsuit has been filed in the District Court of Massachusetts against American Music Group, Inc. for violations of the Fair Labor Standards Act (FLSA). Class members seek to recover unpaid minimum wages, overtime compensation, liquidated damages, attorneys' fees and costs.

Specifically, the complaint alleges that Cindy Lou Peck was hired on December 28, 2001 as an Educational Representative for American Music Group and was employed by them until she was terminated on December 20, 2002. When she was hired, she was informed that her salary would be $28, 500 per year. After she was hired, she was told that her salary would only be $26, 500 per year. Her job included sales and rentals of musical instruments to clients. She spent an average of 60% of her time on on-site service, another 40% on administrative work and alleges that she should have been classified as a non-exempt employee. She worked an average of 85 hours per week, but did not receive overtime compensation for hours worked over 40 per week.

Federal civil rights legislation prohibits discrimination based on gender, age, race, and national origin. A class action has been filed against clothier Abercrombie & Fitch Company on behalf of non-whites who allege that they were wrongfully refused jobs or terminated based on their race, ethnicity, or national origin in violation of Title VII of the federal 1964 Civil Rights Act.
 
Overtime pay is a hot-button issue in the legislative and judicial sectors today. The class has been certified in an action filed against Eastman Kodak Company on behalf of current and former employees of the company alleging that Kodak's overtime payment policies have violated state and federal labor laws since 1996.
