A class action lawsuit has been filed in the Middle District Court of Florida against Mayo Clinic Jacksonville for violations of Florida's Uniform Deceptive Trade Practices Act. Class members seek monetary damages, injunctive and equitable relief, attorney's fees and costs of the litigation.
 
Several class actions have been filed against liability insurer American Physicians Capital, Inc. (Nasdaq:ACAP) and certain of its officers and directors by stockholders who purchased the company's common stock between February 13, 2003, and November 6, 2003. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
The parties have reached a proposed $6,305,000 settlement in a class action against Coast National Insurance Company by former California automobile insurance policyholders who claim that Coast National wrongly canceled their policies for nonpayment of premiums. To recover under the settlement, class members must submit a claim form postmarked by September 15, 2003.
 
A class action has been filed against seven insurance companies on behalf of residents of Maryland, North Carolina, Virginia, West Virginia, Delaware, New Jersey and the District of Columbia, who held flood insurance policies and suffered damage to their houses in September 2003 from Hurricane Isabel. The action alleges that the companies violated their contracts by failing to deliver benefits promised to policyholders.
 
Loan contracts can be extraordinarily complex--you need to read them very carefully before signing on the dotted line. A class action has been filed against World Savings and Loan Association on behalf of California borrowers under secured loans made or serviced by World alleging that the company used unnecessarily expensive hazard insurance policies to illicitly make additional profits, breaching their contracts and violating the California Business and Professions Code.
 
The parties have reached a tentative nationwide $5 million settlement in an action filed against major cellular phone services and three insurance companies on behalf of all persons who purchased wireless equipment insurance between January 1, 1986, and February 20, 2004, through a wireless equipment insurance program administered by Asurion Insurance Services, Inc., Lockton Companies, Inc., or Lock\Line, LLC. The action alleged that the insurance programs failed to comply with applicable state insurance statutes and were marketed in a manner that failed to comply with Pennsylvania's consumer protection statutes. Proof of claim forms must be postmarked on or before August 9, 2004, to be considered valid.
