Assil Sinskey Eye Institute Sued for Violation of the TCPA

A class action lawsuit has been filed in the Los Angeles Superior Court against the Assil Sinskey Eye Institute for violations of the Telephone Consumer Protection Act (TCPA). Class members seek statutory and exemplary damages, restitution and disgorgement of profits derived from "junk fax" solicitation, injunctive relief, attorney's fees and interest.

Specifically, the complaint alleges that the defendant sent unsolicited advertisements via fax on or about May 21, 2004 through September, 2004. The class is tentatively defined as: "All persons, businesses and entities in California who had no prior business relationship with defendants and who received unsolicited advertisements on their facsimile machines sent by, or on behalf of defendants during the applicable faxing period in violation of the Telephone Consumer Protection Act."

The plaintiffs claim that De Beers is a century old cartel, dominating the international rough diamond, controlling as much as 80 percent of the world diamond supply. Currently, the suit alleges, De Beers controls 50 percent of the world’s diamond supply, and an even greater percentage of the supply of two-carat and larger rough diamonds.
 
A class action lawsuit has been filed in Federal Court against behavioral health company Northwestern Human Services. The case involves allegations under the Federal Racketeering and Corrupt Influences (RICO) law. No additional information about the substance of the allegations is available at this time. Ohio University has been sued by two graduates whose Social Security numbers were among more than 173,000 possibly stolen in five instances of data theft from school computers since March 2005. Donald Jay Kulpa, 31, of Cincinnati, and Kenneth Neben, 34, a former Columbus resident now living in North Bergen, N.J., argue their right to privacy has been violated.
