Glass Installer Sues Employer for Violations of FLSA |

A class action lawsuit has been filed in the Northern District Court of Texas against Diamond Triumph Auto Glass, Inc. for violations of the Fair Labor Standards Act (FLSA). Class members seek unpaid wages, attorney's fees and costs.
Specifically, the complaint alleges that Michael Rodriguez was employed by Diamond Triumph as a non-exempt glass installer, regularly worked over forty (40) hours per week, but was not paid overtime compensation as required by the FLSA. In addition, Rodriguez alleges that while he did regularly work over forty (40) hours per week, Diamond did not allow him to record that he worked any time over forty (40) hours per week. He complained to his District Manager about not getting paid overtime, but the Manager was unresponsive to his complaints.

As a collective action, all potential claimants are required to "opt-in" to the case in order to be considered a member of the class.
