Funeral Directors Dead Mad after Not Being Compensated for Overtime

A class action lawsuit has been filed in the Middle District Court of Florida against SCI Funeral Services of Florida, Inc., a Texas based funeral services company, for violations of the Fair Labor Standards Act (FLSA). Class members seek damages in the amount of unpaid overtime compensation owed, liquidated damages or pre-judgment interest, reasonable attorney’s fees and costs of the litigation.

Specifically, the complaint alleges that the plaintiff was employed by the defendants as a Funeral Director/Embalmer on an hourly basis, worked over forty (40) hours per week, but did not receive overtime compensation as required by the FLSA. The complaint further alleges that during the three (3) years prior to filing this action, the defendants had a policy and practice of not paying its Funeral Directors/Embalmers overtime compensation for hours worked over forty (40) per week.

A class action lawsuit has been filed in the Northern District Court of Georgia against Medquist, Inc., a New Jersey based provider of electronic medical transcription, health information and document management services, alleging fraud, breach of contract, demand for accounting, unjust enrichment, negligence, negligent supervision, and Racketeer Influenced and Corrupt Organizations (RICO). Class members seek compensatory damages, punitive damages and restitution.
 
A class action law suit has been filed against Delta Airlines (NYSE: DAL) and certain Delta officers, directors and employees by participants in Delta’s ERISA qualified pension plans. The lawsuit alleges that Delta encouraged plan participants to invest in Delta stock at a time when the airline’s solvency was questionable. The plaintiffs allege that Delta had a duty to warn them about the company’s financial troubles and should not have been offering Delta stock as an investment option when the stocks’ worth was in question. The plaintiffs seek actual damages for the lost value of their stocks as well as restitution to the pension plan by Delta.
 
A statewide collective action with possible national reach has been filed in West Virginia against credit card customer service giant, Applied Card Systems, Inc. The action is brought on behalf of all West Virginia employees of Applied who were not paid proper overtime compensation for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants must voluntarily "opt-in" to the action in order to be considered a member of the class. The employees have requested that the court issue notice to all potential claimants.
 
The International Brotherhood of Teamsters filed a class-action lawsuit alleging that Nashville's Middle Metro Police department has neglected the police officers' pension fund by going six years without a performance audit to show how investments have performed.
