On February 18, 2005, the Court dismissed a class action lawsuit that had been filed in the District Court of New Jersey against Opta Corporation for violations of the New Jersey Consumer Fraud Act. Class members sought compensatory and treble damages, injunctive relief, reasonable attorney's fees, interest and costs of the suit.
This was a consumer class action brought on behalf of all people who purchased a GO-Video DVD Recorder, model number R6530 and/or similar models developed, manufactured, marketed and/or sold by one or more of the defendants.
The recorder was actively promoted and sold through nationwide marketing campaigns, including being sold on QVC and on amazon.com as being of high quality and capable of recording television programs, VHS tapes and camcorder footage onto DVD+R and DVD+RW media formats.
The complaint alleged that the recorder is not compatible with certain types of DVD discs and that the defendants knew of this, but did not make that information public.
