Lowe's Employees Sue for Unpaid OT

A class action lawsuit has been filed in the Middle District Court of Florida against Lowe's Companies, Inc., a North Carolina based home improvement store with 1,000 stores in 45 states, for violations of the Fair Labor Standards Act (FLSA). Class members seek an order enjoining the Company from continuing their current pay policies, compensatory damages, attorney's fees, interest and costs.

Specifically, the complaint alleges that Denise Alvarado was employed as a Sales Specialist at a Lowe's store located in Clearwater, Florida. She regularly worked more than forty (40) hours, but was not paid overtime compensation as required by the FLSA. The complaint alleges that the Company has a nationwide policy and practice of improperly failing to pay Sales Specialists who work more than forty (40) hours in a workweek.

Class members seek compensatory damages, punitive damages and restitution.
 
A statewide collective action has been filed in Florida against Tropical Landscape Lawn Care, Inc. The action is brought on behalf of all current and former employees, who since April 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A collective action has been filed in Florida against WHB Parking Systems, Inc. who operate under the name, USA Parking System. The action is brought on behalf of all Florida employees of WHB who have not been paid proper minimum wage or who have had wages due to them withheld by the company. The action is brought under the federal Fair Labor Standards Act and seeks back pay, statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action all potential claimants must "opt-in" in order to be a member of the class. The employees have requested that notice be sent to all potential claimants.
