Homier Mobile Merchant Employee Sues for Unpaid Overtime

A purported class action lawsuit had been filed in the Northern District Court of Indiana against Indiana based retailer Homier Distributing Company, Inc., DBA Homier Mobile Merchants, for violations of the Fair Labor Standards Act (FLSA). Class members sought unpaid overtime compensation, costs and attorney’s fees.

Specifically, the complaint alleged that Terri Reich was employed by Homier from May 2002 to October 2003 as part of a crew which traveled from place to place setting up and running sales shows. Reich alleged that she frequently worked in excess of forty (40) hours, but was not paid one and one-half times her regular rate of pay (overtime) as required by the FLSA.

The case was not certified as a class action and was settled as to the principal defendant.

As the result of an alleged continuous pattern of labor violations, another collective action has been filed in Florida against the School Board of Broward County, Florida. The action is brought on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the board. The action is brought under the federal Fair Labor Standards Act and is seeking back pay as well as statutory damages, liquidated damages and declaratory relief.
 
A collective action has been filed in Florida against restaurant re-modeler, Rightway Services of Florida, Inc. The action is brought on behalf of all Florida residents who either are currently employed by or were employed in the past by Rightway and who were not paid overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages, back pay and injunctive and statutory relief. As a collective action, all potential claimants must "opt-in" voluntarily in order to be considered part of the class. The employees have requested that the court issue notice to all potential claimants.
 
A class action has been filed against Mack Construction Services, Inc. (Mack) and its owners for allegedly violating the Fair Labor Standards Act (FLSA). The complaint alleges that the Company is subject to the provisions of the FLSA, knew that they must pay their employees overtime compensation, required employees to work overtime, but did not pay for overtime hours worked.
 
A statewide collective action has been filed in Florida against Vogue International, Inc. The action is brought on behalf of all current and former employees, who since March 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
