A group of six current female executives filed a class action gender discrimination case in the Southern District of New York against Dresdner Kleinwort Wasserstein ("DrKW"), a German investment bank, whose parent company is Dresdner Bank AG, a member of the Allianz Group. The six current executives have been with DrKW for a total of 50 years. A class action has been filed on behalf of home health care workers employed by the Central State Community Services, Inc., a Tulsa based provider of home health services. The suit alleges that workers employed at Central State between 2001 and 2004 routinely worked more than 40 hours a week but were not paid overtime as required by the Federal Fair Labor Standards Act. The plaintiffs seek an award of the unpaid overtime with interest, attorney’s fees and costs, as well as liquidated damages and equitable relief. A national class action has been filed against prescription drug plan operator Express Scripts, Inc. on behalf of all U.S. citizens who were or are participants in or beneficiaries of any employer-provided prescription benefit plan (1) that required participants or beneficiaries to pay a percentage co-pay for prescription drugs and (2) for which Express Scripts, Inc. or one of its predecessors-in-interest or subsidiaries serves or has served as the plan's provider of prescription drugs at any time from October 1, 1997, through the present. The action is brought under the Employee Retirement Income Security Act (ERISA) and claims that Express Scripts breached its fiduciary duty to plan participants and beneficiaries in several ways. The participants are seeking declaratory and injunctive relief and a court order requiring Express Scripts to make an accounting of and reimburse consumers and benefit plans all monies earned through allegedly unlawful activities.
A collective action has been filed in Florida against the School Board of Broward County, Florida. The action is brought on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the board. The action is brought under the federal Fair Labor Standards Act and is seeking back pay, statutory damages, liquidated damages and declaratory relief. A class action has been filed on behalf of retirees who retired from the Case Corporation (now known as CNH Global NV) on or after July 1, 1983 and were under 62 years of age at the time of retirement. The suite alleges that Case denied such retirees supplemental benefits due to them under negotiated collective bargaining agreements and in violation of federal law. A class action lawsuit has been filed in United States District Court for the Southern District of Florida against Fire of Brazil III. The case involves violations of federal labor law.
