Eckerd Consumers Sue Company for Violations of FDCPA

A class action lawsuit has been filed in the Eastern District Court of New York against Eckerd Corporation, a Florida based retailer, for violations of the Fair Debt Collection Act. Class members seek injunctive and declaratory relief as well as damages, attorney's fees and costs.

Specifically, the complaint alleges that, in the course of offering pharmacy services and healthcare products, Eckerd sent consumers debt collection letters bearing the Eckard logo and concluding with a signature line that read, "Very truly yours, Eckerd Drugs" which stated that the consumer's check has been returned by the bank as unpaid. Class members feel that this practice violates the Fair Debt Collection Practices Act (FDCPA) as CRA Security Systems, Inc. is actually sending these letters to consumers.

The class period began one year prior to filing this action.

On July 28, 2003, the court granted final approval to the parties' $12.6+ million settlement in a class action against AccuBanc Mortgage Corporation and National City Mortgage Company on behalf of all persons who paid document preparation, documentation or document processing fees, processing fees, administrative fees, underwriting fees or wire fees to either or both of the companies in connection with the origination of a residential mortgage in California between May 3, 1996, and April 21, 2003.
 
A class action lawsuit has been filed in the Southern District Court of Indiana against Commonwealth Financial Systems, Inc. for violations of the Fair Debt Collection Practices Act (FDCPA) which prohibits debt collectors from engaging in abusive, deceptive and unfair collection practices. Class members seek statutory damages, reasonable attorney's fees and costs of the litigation.
 
On September 21, 2005, the court granted final approval of a settlement in a class action that had been filed against Indiana attorney Bart E. Carroll arising from his actions as a debt collector. The action was on behalf of all person from whom Mr. Carroll attempted to collect a debt at any time since October 8, 2002, but to whom he did not provide a debt validation notice either in the initial contact or within five days of that contact. The action alleged that Mr. Carroll had repeatedly violated the federal Fair Debt Collection Practices Act (FDCPA) in his efforts to collect outstanding debts from consumers.
 
New York State Attorney General Eliot Spitzer filed a $250 million fraud suit against H&R Block Inc., accusing the nation's largest tax preparation service of fraudulently pushing clients to invest their tax refunds in retirement accounts that had high fees and low returns. The lawsuit is on behalf of customers who have opened the Express IRA accounts.
 
State and federal laws limit the amount of interest that a business may charge on a loan. The parties have reached a tentative settlement in an Indiana class action against short-term loan provider E-Z Cash Systems, Inc. on behalf of all persons who took out a loan with the business and were forced to pay an interest rate that was allegedly too high in violation of state and federal lending laws.
