MA Attorney Sued for Violations of Fair Debt Collection Act

A class action lawsuit has been filed in the Southern District Court of New York against JA Cambece, Esquire, a debt collection law firm in Peabury, Massachusetts, for violations of the Fair Debt Collection Act. Class members seek statutory damages, costs and attorney's fees.

Specifically, the complaint alleges that the plaintiff incurred a debt in the amount of $7,430.95 to Fleet Bank which was forwarded to the defendant for collection. The law firm sent a computer generated letter that was allegedly false, deceptive and misleading because the least sophisticated consumer would believe that the letter, and all documents concerning the alleged debt, were reviewed by an attorney.

The letter (which can be viewed in the complaint provided by ClassActionAmerica.com), tells the debtor that an offer to provide monthly payments will "expire soon" when, in fact, New York law allows debtors to pursue that option at any time. In addition, the letter represented that the attorney was admitted to practice law in the state of New York, but is not.
The class period is one year prior to the filing of this complaint.

A class action lawsuit has been filed on behalf of Indiana residents who received dunning notices from Calumet Adjustment Bureau. The suit alleges that Calumet failed to adhere to the requirements of the federal fair debt collection practices act in its interactions with debtors.
 
A statewide class action has been filed in Connecticut against collection specialist, Peter Roberts and Associates, Inc. The action is brought on behalf of all Connecticut residents from whom Roberts attempted to collect allegedly illegal collection fees in connection with an attempt to collect an outstanding debt. The action is brought under the federal Fair Debt Collection Practices Act and is based upon Connecticut consumer laws. The consumers are seeking compensatory damages as well as injunctive and declaratory relief.
 
A class action has been filed against debt collection agency Amsterdam & Lewinter, LLP, on behalf of all persons with New York state addresses, to whom a collection letter was sent between July 15, 2003, and July 15, 2004. The action alleges that the defendants violated the federal Fair Debt Collection Practices Act by using deceptive trade practices in its attempts to collect an alleged debt.
 
Check cashing operations have been coming under national scrutiny over the amount of interest that they charge. The parties have reached a tentative $1.1 million settlement in an action filed against Famous Pawn, Inc. on behalf of all persons who entered into a check-cashing transaction with any Maryland Famous Pawn location between May 11, 1996, and February 5, 2003. Claim forms must be postmarked by December 4, 2003, to be considered valid.
 
Short-term payday loans often unfairly gouge consumers by charging excessive interest rates in the form of "fees." A class action has been filed against numerous payday loan businesses, all of which are owned by Richard D. Clay, II, on behalf of all persons who entered into short-term loan transactions with them, alleging that the businesses violated the federal Racketeer Influenced Corrupt Organizations (RICO) and Truth in Lending Acts, and Georgia's civil and criminal usury statutes, when the businesses charged the consumers excessive interest rates on the loans.
 
A class action lawsuit has been filed against New York collection agent Riddle & Associates, PC. The suit alleges that the defendant engaged in abusive and deceptive collection practices that violated federal fair debt collection practices laws. The suit seeks to certify a national class and collect actual and punitive damages on behalf of the plaintiffs.
