Former employees recently sued Software publisher Activision for failure to pay overtime compensation as required by California law. A statewide collective action has been filed in Florida against Cingular Wireless, LLC. The action is brought on behalf of all current and former inside sales associates, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. A class action has been filed against Rolling Frito-Lay Sales, LP by the company's California delivery drivers, who allege that Frito-Lay improperly calculated their overtime wages based on a "fluctuating work week method," which violates California law. The court presiding over a lawsuit against the office retailer Staples, Inc. has granted the lawsuit class-action status for alleged violations of a California wage law.
Staples, Inc. , based out of Framingham, Mass., said in a document filed with the Securities and Exchange Commission that the court's ruling is procedural only and doesn't address the merits of the plaintiffs' allegations.
A purported class action lawsuit had been filed in the Northern District Court of Indiana against Indiana based retailer Homier Distributing Company, Inc., DBA Homier Mobile Merchants, for violations of the Fair Labor Standards Act (FLSA). Class members sought unpaid overtime compensation, costs and attorney’s fees.
