Hourly Employees at All Purpose Insurance Claim the Company Willfully Refused to Pay Overtime

A class action lawsuit has been filed on behalf of hourly employees at Florida based All Purpose Insurance, Inc. The suit alleges that the company routinely denied overtime pay to employees who had worked hours in excess of 40 per week. The workers are seeking back overtime pay and other damages.

All Purpose Insurance is alleged to have routinely denied overtime to customer service representatives at the company, notwithstanding the fact that these workers are employed on an hourly basis and routinely worked more than 40 hours in a given week. Under the federal Fair Labor Standards Act (FLSA) employers are required to pay overtime pay of 1.5 times the regular rate to hourly employees for any hours worked in excess of 40 per week.

The workers seek back overtime pay plus liquidated damages for each worker included in the class.

A 2004 lawsuit that claimed three south Louisiana school systems failed to pay overtime to hundreds of employees may get a second chance at being granted class action status. Attorneys that filed the case originally missed the deadline for certifying the case as a class action and ignored demands to explain why.

As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A nationwide class action has been filed in Georgia against publishing giant Primedia, Inc. and its subsidiary Haas Publishing Companies, Inc. The action is brought on behalf of all employees who are beyond the age of 40 and have been either terminated from employment, or forced to resign, as a result of age discrimination. The action is brought under the federal Age Discrimination Employment Act and seeks compensatory and statutory damages as well as injunctive and declaratory relief.
