A statewide collective action has been filed in Florida against J&B Today's, Inc. The action is brought on behalf of all current and former hourly employees of all Florida J&B Today's stores, who since May 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. A nationwide class action has been filed in Georgia against publishing giant Primedia, Inc. and its subsidiary Haas Publishing Companies, Inc. The action is brought on behalf of all employees who are beyond the age of 40 and have been either terminated from employment, or forced to resign, as a result of age discrimination. The action is brought under the federal Age Discrimination Employment Act and seeks compensatory and statutory damages as well as injunctive and declaratory relief. A class action lawsuit has been filed in the Western District Court of Oklahoma against Oklahoma based Alderwoods Group, dba Resthaven Funeral Home aka Gaskill-Owen Funeral Chapel for violations of the Fair Labor Standards Act (FLSA). The lawsuit seeks to recover unpaid compensation in the form of wages, on-call time, commission sales, bonuses, attorney's fees and costs. State and federal laws protect persons from discrimination based on their race, color, ethnicity, and gender. The parties have reached a $36.5 million settlement in a class action filed against United Airlines, Inc. on behalf of female flight attendants, who allege that companies use of different weight policies from male and female flight attendants between 1989 and 1994 constituted illegal sex discrimination under federal and state law. Claim forms must be postmarked by March 15, 2004, to be considered valid. The federal Fair Standards Labor Act requires that most hourly employees be paid overtime wages if they work more than 40 hours in a normal workweek. A nationwide class action has been filed against office supply superstore operator OfficeMax, Inc. on behalf of employees who allege that the company has not paid them overtime for hours they work in excess of their normal 40 hour workweek, in violation of the federal Fair Labor Standards Act. Qualified employees should join the action as soon as possible to prevent forfeiture of benefits because of the operation of federal statutory deadlines.
