Other Employment Cases of Interest

A collective action has been filed in Florida against restaurant re-modeler, Rightway Services of Florida, Inc. The action is brought on behalf of all Florida residents who either are currently employed by or were employed in the past by Rightway and who were not paid overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages, back pay and injunctive and statutory relief. As a collective action, all potential claimants must "opt-in" voluntarily in order to be considered part of the class. The employees have requested that the court issue notice to all potential claimants.
 
The court has certified a class of African American employees of Florida state mental hospitals who are seeking pension compensation as "special risk" employees based on their duties at the facilities, which often bring them in direct contact with dangerous residents.
 
In 2000, California Supreme Court ruled that workers must get paid for compulsory travel time. The court has rendered a $13+ million and verdict in a class-action filed against D'Arrigo Brothers Company on behalf of laborers, who alleged that the company failed to pay them for thousands of hours spent traveling on company vans to and from the crops they picked between 1996 and 2000. The money will not be distributed until all possible appeals have been exhausted.
 
Federal law prohibits sexual harassment in the workplace. A class action has been filed against business consulting service International Profit Associates, Inc. on behalf of current and former female employees who allege that they were her arrest sexually on the job in violation of federal civil rights laws.
 
A class action lawsuit has been filed in the Northern District Court of Texas against Zale Corporation, a Texas based diamond store and jeweler, for violations of employment law, specifically for racial discrimination. Class members seek declaratory judgment, damages, attorney's fees and costs.
 
Federal law protects workers from unexpected job losses due to unexpected layoffs. A $1.27 million judgment has been entered against the Chicago Housing Authority in favor of police officers, security officers, and employees in the authority's police department, which was closed in October 1999 without giving 60 days' notice to workers, as is required under the federal Worker Adjustment and Retraining Notification Act (WARN Act), thereby violating the act.
