A statewide class action has been filed in Indiana against the Frosty Management Corporation. The action is brought on behalf of all Indiana residents who are currently, or who have been, employed by Frosty as assistant managers and who have not received overtime compensation during their employment with Frosty. The action is brought under the federal Fair Labor Standards act and seeks back pay and liquidated damages as well as injunctive and declaratory relief.
A statewide class action has been filed in Indiana against attorney Lawrence Reuben and the Law Offices of Lawrence Reuben. The action is brought on behalf of all Indiana consumers who, since January 21, 2003, have received a collection letter from Reuben or his law office which did not include the federally mandated language regarding consumers' rights to dispute the validity of the debt being collected. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief. A statewide collective/class action has been filed in Illinois against the TJX Companies, who operate Marshalls, the discount clothing giant. The action is brought on behalf of all Illinois residents who have been employed by Marshalls in the period since February 2001 as hourly employees. The action is brought under both the federal Fair Labor Standards Act and Illinois wage and labor laws and seeks back pay, compensatory, statutory, liquidated and punitive damages as well as injunctive and declaratory relief. Under the Fair Labor Standards Act, all those who wish to join the collective action must voluntarily "opt-in" in order to be considered a member of the class. The employees have requested that the court issue notice to all potential claimants. Police officers must have reasonable cause to suspect that a person has committed a crime before they can arrest him or her. Two class actions have been filed against the City of Detroit on behalf of persons who allege that they were arrested unlawfully in police murder investigations in violation of their civil rights.
A recently filed class action lawsuit alleges that a Mobile County funeral company discriminates against African-Americans. The SLG Group owns and operates Serenity Funeral Home, Serenity Memorial Garden, Lawn Haven Memorial Gardens and Gulf Coast Vault in Mobile County, Alabama. The lawsuit, filed March 16, alleges that Serenity Funeral Home "attempts to bury only Caucasians in Serenity Memorial Gardens and only African-Americans in Lawn Haven Memorial Gardens."
"Almost all of the deceased buried in Serenity are Caucasian. Almost all, if not all, of the deceased buried in Lawn Haven are African-American," the lawsuit says. State and federal law prohibits discrimination in public accommodations based on race, color, religion, sex or national origin. A class action has been filed against J.C. Penney Company, Inc. on behalf of African Americans and other non-white shoppers who allege that, because of their race or color, they have been wrongfully targeted for shoplifting at J.C. Penney stores located throughout New York City and subsequently subjected to unlawful search and seizures, falsely imprisoned, harassed, and had their personal property wrongfully confiscated or damaged in violation of state and federal civil rights laws.
