A class action lawsuit has been filed in the Eastern District Court of New York against Diego Construction, Inc. for violations of the Fair Labor Standards Act (FLSA). Class members seek unpaid overtime compensation, costs and attorney’s fees. A nationwide class action has been filed in Ohio against supermarket giant, The Kroger Company. The action is brought on behalf of all current and former employees of Kroger whose health insurance was either reduced or cancelled while on medical leave or who were not reinstated to their previous position once they returned from medical leave. The action is brought under the federal Family Medical Leave Act and seeks statutory and liquidated damages as well as injunctive and declaratory relief. A class action has been filed on behalf of current and former employees of RCN Corporation who participated in its Retirement Investment and Stock Purchase plans between January 12, 1999 and the present. The suit alleges that fiduciaries for the RCN plans induced plan participants to make significant investments in RCN stock through misrepresentations regarding the financial status of the company, in violation of the Employee Retirement Income Security Act (ERISA). A national class action filed against health and beauty company Avon Products, Inc., on behalf of independent sales representatives, has been revived by an appellate court after being dismissed by the Los Angeles County Superior Court. The lawsuit alleges that Avon artificially boosted its financial performance by "channel stuffing " -- forcing independent sales representatives to pay for unordered products even after the shipments are returned to Avon, in violation of California unfair competition and business practices laws. California's labor laws are more protective of its workers than most states'. The class has been certified in a California class action filed against business products service company IKON Office Solutions, Inc., on behalf of commissioned salespersons who allege that the company compels them to return commissions on failed accounts in violation of California unfair business practices and labor laws. A statewide collective action has been filed in Florida against Tropical Landscape Lawn Care, Inc. The action is brought on behalf of all current and former employees, who since April 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
