A class action lawsuit has been filed in the Middle District Court of Florida against SCI Funeral Services of Florida, Inc., a Texas based funeral services company, for violations of the Fair Labor Standards Act (FLSA). Class members seek damages in the amount of unpaid overtime compensation owed, liquidated damages or pre-judgment interest, reasonable attorney’s fees and costs of the litigation. The federal Fair Standards Labor Act requires that most hourly employees be paid overtime wages if they work more than 40 hours in a normal workweek. A nationwide class action has been filed against drugstore chain operator CVS RX Services, Inc., on behalf of current and former pharmacist employees who allege that the company has not paid them overtime for hours they work in excess of their normal 40-hour workweek, in violation of the Fair Labor Standards Act. Qualified employees should join the action as soon as possible to prevent forfeiture of benefits because of the operation of federal statutory deadlines.
Asbestos-related work injuries can be devastating. The parties have reached a tentative $375 million settlement in several class actions filed against Travelers Property Casualty Corporation on behalf of persons exposed to asbestos and their families, who allege that the insurer engaged in unfair trade practices by inappropriately handling and settling asbestos claims. A class action immigration lawsuit has been filed against Cafe Express, its parent company Wendy's International, Inc. and its former law firm on behalf of nearly 100 undocumented employees who were recently fired. Grocery chain Smart & Final reached a tentative $19 million agreement in a class-action lawsuit claiming employees were not properly paid.
The employees alleged the Los Angeles-based chain failed to properly calculate overtime pay and also neglected to pay for all hours worked. The suit also alleged other compensation was not paid. A statewide collective action has been filed in Florida against The Wachovia Corporation and Wachovia Mortgage Corporation. The action is brought on behalf of all current and former employees, who since April 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
