A class action has been filed against Maxim Pharmaceuticals, Inc., a global biopharmaceuticals company (NASDAQ:MAXM) and certain of its officers and directors by stockholders who purchased the company’s common stock between November 11, 2002 and September 17, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company’s securities. The stockholder seek to recover compensatory damages for the loss of value of their stock. A class action lawsuit has been filed on behalf of uninsured patients who received and were billed for medical care by any hospital within the South Dakota based Avera Health network of hospitals. The suit contends that Avera billed its uninsured patients at rates far in excess of the rates employed for insured patients and that this practice was and is both discriminatory and illegal. Uninsured hospital patient Robert Honke filed a lawsuit against Alton Memorial Hospital in Madison County Circuit Court, Illinois. Honke claims AMH charged him more for services than for patients with health insurance.
According to the complaint, AMH was to only charge Honke reasonable and customary rates for healthcare services and he would only be obligated to pay reasonable charges for the services he received.
Kahn Gauthier Swick is seeking to file a lawsuit on behalf of persons that have certain Medtronic implantable heart devices. These products were surgically implanted in persons that are either prone to life-threatening heart rhythms, congestive heart failure or a combination of both. Several class actions have been filed against temporary nurse staffing company Cross Country Healthcare, Inc., (Nasdaq:CCRN) and certain of its officers and directors by stockholders who purchased the company's common stock between October 25, 2001, and August 6, 2002. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The parties have reached a tentative settlement in a class action filed against United Wisconsin Life Insurance Company, American Medical Security, Inc., Prescription for Good Health Trust and AmSouth Bank on behalf of all persons in Alabama and Georgia who purchased a certificate of medical insurance from United Wisconsin. The legal notice describing the class action does not state the deadline for filing claims under the settlement.
