The parties have reached a tentative $120,000 settlement in an action filed against NCO Financial Systems, Inc. on behalf of all persons who took out a personal loan which was previously owned or serviced by Commercial Financial Services (CFS), and which was reported by NCO to one or more credit reporting agencies between October 10, 1999, and March 31, 2004. The action alleged that NCO violated the federal Fair Debt Collection Practices Act by reporting false information to credit reporting agencies. A statewide class action has been filed against the National City Mortgage Company on behalf of all South Carolina residents who were issued a mortgage by National City Mortgage that understated the annual percentage rate of interest due to the fact that National City included fees for points and brokerage fees in the amount financed.
A class action, which apparently covers all U.S. residents, has been filed against insurance giant Farmers Insurance Company, Inc. and its parent, Farmers Group, Inc., on behalf of consumers who, since November 5, 1998, purchased either an automotive or a homeowner's insurance policy with Farmers and later was given a rate increase due to Farmers' alleged utilization of credit reports without the consumer's consent or knowledge. The action is brought under the federal Fair Credit Reporting Act and the Arkansas unfair trade practices law and seeks actual damages, statutory and punitive damages and declaratory relief.
KPMG and Sidley, Austin, Brown & Wood have reached a $225 million settlement with plaintiffs in a class action suit that charges the firms with having sold bogus tax shelters.
The settlement hearing in Simon v. KPMG LLP, is subject to approval by U.S. District Judge Dennis Cavanaugh in Newark, N.J., is scheduled for October 7, 2005. A class action has been filed in Florida against Butler & Hosch, P.A.. on behalf of all Florida residents who were required to pay prepayment penalties on mortgages that were accelerated as part of a foreclosure action. According to the mortgagees, Florida law does not permit the collection of prepayment penalties once a mortgage has been accelerated during foreclosure. The action is brought under the federal Fair Debt Collection Practices Act and Florida consumer laws. The mortgagees are seeking actual damages as well as the maximum statutory damages allowed under the FDCPA.
A class action lawsuit has been filed against H&R Block, a national tax preparation company, in the Southern District Court of West Virginia for violations of federal banking laws. Class members seek damages, attorney's fees and costs of the litigation.
