A class action has been filed against Wal-Mart Stores, Inc. and numerous janitorial services on behalf of immigrant workers who allege that the companies conspired to cheat them out of their wages and overtime pay in violation of the federal Racketeering Influenced Corrupt Organizations Act.
As the result of an alleged continuous pattern of labor violations, another collective action has been filed in Florida against the School Board of Broward County, Florida. The action is brought on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the board. The action is brought under the federal Fair Labor Standards Act and is seeking back pay as well as statutory damages, liquidated damages and declaratory relief. The parties have reached a tentative $538,000 settlement in a class action filed against clothier The Gap, Inc. on behalf of African-American employees who were employed at the Gap's Gallatin, Tennessee, campus between October 7, 1999, and September 12, 2003. The action alleged that they were discriminated against in violation of the federal Civil Rights Act of 1964 and the Tennessee Human Rights Act.
